Terms of Service

Welcome to Cari-Me. By using the Service, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Service Provider

2. Service Description

Cari-Me is an AI-powered web and mobile application that transforms user-submitted photos into caricature artwork using third-party AI providers (Google Gemini).

3. Eligibility

You must be at least 16 years old to use Cari-Me. By using the Service, you confirm that you meet this requirement.

4. Free and Pro Plans

• Free: 3 caricature generations per 24-hour rolling window. Generated caricatures are not saved on our servers.
• Pro (€0.99 / month): unlimited daily generations and permanent caricature history saved to your account.

Pro is a monthly recurring subscription processed by Stripe on the web, or via Apple App Store / Google Play in the mobile apps. It auto-renews each month until cancelled.

5. Cancellation

You can cancel your Pro subscription anytime:

• Web: via the Stripe customer portal accessible from the app.
• iOS App Store: via your Apple ID Subscriptions settings.
• Google Play: via your Google Play Subscriptions settings.

Upon cancellation, you keep Pro access until the end of the current billing period.

6. Right of Withdrawal (EU consumers)

Under Belgian law (Article VI.47 of the Code of Economic Law), you have a 14-day right of withdrawal for digital services.

By starting to use the Service immediately upon subscribing (i.e. generating your first Pro caricature), you expressly waive this right in accordance with Article VI.53 4° CDE.

If you did not use the Service after subscribing, contact dmitriev.tom@gmail.com within 14 days for a full refund.

7. Acceptable Use

You agree NOT to use Cari-Me to:

• Upload photos of others without their consent.
• Generate content that is illegal, sexually explicit (especially involving minors), defamatory, harassing, or hateful.
• Violate any third party's intellectual property rights.
• Attempt to bypass quotas, reverse-engineer the app, or interfere with the Service.

Violation may result in account termination without refund.

8. Intellectual Property

• You retain all rights to the original photos you upload or capture.
• You grant us a limited, non-exclusive, worldwide license to process your photos for the sole purpose of generating caricatures.
• You own the generated caricatures and may use them for personal or commercial purposes, subject to the underlying terms of the AI provider (Google Gemini).

9. Disclaimers

The Service is provided "as is", without warranties of any kind. AI-generated content may be unexpected, inaccurate, or unsuitable. We do not guarantee specific results, availability, or uptime.

10. Limitation of Liability

To the maximum extent permitted by Belgian law, our liability is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

This limitation does not apply to liability that cannot be excluded under Belgian consumer protection law.

11. Termination

We may suspend or terminate your account for violations of these Terms or applicable law. You can stop using the Service at any time.

12. Modifications

We may update these Terms. Material changes will be notified via the app. Continued use after notification constitutes acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms are governed by Belgian law. Any dispute will be resolved before the competent courts of Brussels, subject to mandatory consumer protection rules that may grant consumers the right to bring proceedings in their place of residence.
